COMMISSION AGENT’S CLAIM.
A SHANNON CASE.
Judgment in a ease concerning a Shannon land transaction was delivered in the Magistrate’s Court at Wellington on Tuseday by Mr A. G. Biddell, W.M. The plaintill was J. B. G. Stansell, land agent, of Shannon, and the defendant T. H. A. Tremewan, fanner, the claim being for £lB5, alleged to be due as commission on the sale of defendant’s interest in a native lease at Shannon to Messrs Barber Bros., for £3,700, the commission being at the rate of 5 per cent. After referring to.the negotiations, the Magistrate said that in his opinion plaintill: had established his claim to commission unless precluded by section 13 of the Land Agents Act, 1912. That section enacted that a land agent shall not be entitled to sue for or recover any commission, reward or remuneralion for or in respect of the sale or other disposition of land or of any interest in land made or eilecled after the coming into operation'of this Act unless (a) he was the holder of a license, under the Act, or (b) his engagement or appointment to act as agent in respect of such sale or disposition was in writing signed by the person to be charged with such commission, reward or remuneration. The Magistrate quoted an analogous case, and stated thgt in his opinion plaintiff had failed to prove compliance with section 13, and could not therefore succeed. Plaintiff was non-suited with costs (£9 ss). Security for appeal was fixed at £lO 10s.
