MUNICIPAL PICTURE ENTERPRISE.
MOTION FILED FOR AN
INJUNCTION
RESTRAINING COUNCIL FROM CONTINUING.
The Town Clerk has been served with notice of motion on behalf of Marie Hamer, wife of William Hamer, of Foxton, asking that an order be made restraining the Council from carrying on the business of showing moving pictures in the Borough of Foxton, or from showing or exhibiting moving pictures or from using the funds of the Corporation in connection with such business, upon the grounds that the Council has not any authority at law nor any right or power to carry on, manage or conduct such business, or to use the funds of the Corporation for the purpose of carrying on, managing or conducting such business and upon the further grounds set out in the plantiff’s statement of claim, a copy of which has also been served on the Town Clerk together with affidavits of Marie Hamer and William Hamer.
Messrs Mason and Oram, of Palmerston North, are solicitors for the plaintiff and the motion is to be moved at the Supreme Court at Palmerston North, before the Chief Justice (Sir Robert Stout) on Monday, the 25th instant, at 10 a.m. or as soon after as Counsel can be heard.
