SPORTSMEN’S MISTAKE.
AN EXPENSIVE BAG
Mr J. W. Poyuton, S.M., heard a case at the Magistrate’s Court, Palmerston, on Tuesday, when Arthur Sexton, of Himitangi, claimed from two lads, T. V. Sherson and P. Churcher, of Feilding, value of ten Indian Runner ducks shot by defendants. Plaintiff in evidence, stated that the ducks were purebred and kept for laying purposes. Each duck would lay over 100 eggs iu a season. He heard shots and upon investigating found the defendant lads with the ducks in their possession. It was stated by the defendants that they did not know the Indian Runners were tame. His Worship stated that, in cases of trespass, property injured was presumed to be of the very best, and this was a case, he thought, in which such a presumption, should be exercised. Judgment would be for plaintiff for £j xos less £$ paid into Court, costs 15s, witnesses’ expenses £1 is, solicitor’s fee £1 6s.
