TPIE “NATIVE” CASE. The following decision was given at Wellington on Tuesday by the Hon. J. D. Oimond, Messrs George Plunter, and C. P. Skerrett, judges appointed to deal with The Native appeal case. “We have considered the appeals lodged by Timi Puru aud Charles Price of The Native irom the decisir, u of the stewards of the Canterbury J.C., and from the decision of the Canterbury District Committee, which latter body dismissed the appeals on the grounds that the finding of the stewards was that there was a jostle, and that under rule 7, part xxxi, such finding was conclusive and not subject to appeal. “We have enquired carefully into the procedure adopted by the stewards iu the conduct ot the enquiry, and we have satisfied ourselves that although in some respects their procedure was irregular uo sufficient ground has been shown to justify our setting aside their decision, and requiring them to rehear the matter. “We are further of opinion that the finding of the stewards is under the rules conclusive, both as to the fact of the jostle and as to consequences following such jostle, aud that their decision is not subject to appeal. The appeals are consequently dismissed. “We do not think it uecessary to give a direction as to the deposits lodged by the appellants, and such deposits will accordingly under the rules, be returned to them.”
