MISREPRESENTING A FARM.
INTERESTING WOODVILLE CASE.

His Honour Mr Justice Cooper was engaged on Saturday, at Palmerston North, in hearing an interesting case in which Albert James Wells sued Frederick R. Doubleday lor damages for alleged misrepreseutaton. Evidence was led to prove that defendant represented to plaintiff that a farm of 44 acres which he sold to plaintiff was capable of carrying 20 to 21 cows and of wintering 16 or 17 ; that the daily supply of milk was between 400 and 6oolbs; and that 14 of the cows were in calf to Remnant’s prize Holstein bull. Plaintiff stated that his first lot of milk taken to the factory was 3231b5, and the two succeeding days Soolbs and 3islbs. Plaintiff could not see how he was going to make the farm pa}' at that, and asked defendant to take it back. He said he would if plaintiff would forego £So or ,£IOO. Eater on he made it .£l5O, and plaintiff rather than keep the farm let defendant have the ,£l5O. Edward Pritchard, a creamery manager, said defendant came to him one day and said : “ What did you want to tell Wells what milk 1 brought ? A nice way you’ve put me in now. I told him I had brought between 600 and yoolbs of milk.” William Remnant, owner of the prize Holstein bull, contradicted the statement as to defendant’s cows being in calf. After hearing the evidence his Honour held that the defendant misrepresented the position and gave judgment for and costs.
