INCOME TAX CASE.

Dunedin, March 30

In November last the Commissioner of Taxes sued J, L. Denniston, agent for certain non-re-sident traders, for income tax. The amount originally claimed was £<) 3s nd., but on Mr Denuistou refusing to pay the Commissioner reassessed the amount at 9s gd, and sued for that amount. The magistrate held that defendant was not protected under the Act, and gave judgment for the Commissioner, Defendant lodged an appeal to the Supreme Court on a point of law. After further consideration, however, the Crown has decided that the magistrate’s decision cannot be supported, and has intimated that no effort will be made to collect the tax.
