APPEAL COURT.
Validity of Securities.
The Court gave its decision at Wellington yesterday with respect to the appeal of Levin and Co., Ltd., from the judgment of the Chief Justice in the action between the representatives of the late James Reed, formerly of Palmerston North, and afterwards of Sydney (medical practitioner), and George A. Simpson (of Foxton, flaxmiller), wherein His Honour adjudged certain securities held by Levin and Co., Limited, to be void as affecting the property of the partnership of Messrs Reed and Simpson. Their Honours decided to refer the case back to the Supreme Court for re-trial, both as to law and fact, all questions of costs of the appeal as well as the costs in. the Supreme Court to be settled at the re-trial. Mr. Bell, K.C, (with him Mr. Ostler), appeared on behalf of Levin and Co., Ltd. (apellants), and Mr. Skerrett, K.C. (with him Mr. Clifford Moore, of Palmerston North), for the representatives of the late Dr. Reed (respondents).
