Richard Daly pleaded not guilty to a charge that on April 17, 1906, at Foxton, he wilfully made a false declaration for the purpose of securing a certificate of marriage and, further, that on the same date he made a false stateraant to wit that he was a bachelor, whereas he was a married man.
A. D. Cleraett, Registrar at Foxton, produced his books and gave evidence in support of the charge, and added that two days after the certificate was issued on accused’s statements accused came back to his office and was married by witness.
Detective Quirke produced the cetificates of the first marriage of accused with KmilyCooper in 1895, and also a statement made by the accused as to his marriage wkh Alice Funnel in Foxton in 10,06. He admitted in the statement that he told the Registrar that he was a single man and made it upon the statement of a friend who told him his wife was dead. Daly did not make any statement to verify this statement because be had been away from his wife for fully seven years, and thought that he was free to marry again.
The jury, after a retirement of about 40 minutes, returned with a verdict of “Not Guilty,” and Daly was discharged.
