Netting at the mouth of Rivers. Judge Reserves his Decision. Dunedin, March 26. At the Supreme Court, in Chambers, before his Honor Mr Justice Williams, B. S. Irwin moved for a rule ■ absolute restraining the Acclimatisation Society and Mr Widdowson,S.M., from proceeding in the matter of the conviction of one Leslie, for placing a net at the mouth of the Water of Leith, Mr Irwin moved for a rule on the ground that the regulations were ultra vires, on account of a subsequent Act repealing the original Act. Mr W. C.' MacGregor (who appeared for the Society) contended that the first Act was for the protection of fresh water fish, including trout, and the second for the protection of sea water fish, and that they did not conflict. Trout, though fresh water fish, occasionally “ toured ” in salt water.

The point raised is one of considerable importance. Mr Irwin put it to his Honor that if Mr MacGregor’s argument were correct, the regulation would do away with coastal fishing altogether, but Mr MacGregor ridiculed the idea. His Honor reserved his decision.
