THE. FINDING OF THE JURY.

" . Sydney, December 4. The jujry in the Dailey divorce

p^ se » r h which the petitioner, who is a'joa of the late Hon. W. B. DAiley, sought to obtain a dissection ot his marriage on the ground of his wife’s adultery with his (the petitioner’s younger brother, retired at 11.30 o’clock yesterday morning. The case lasted nineteen days, four days being occupied with counsel’s addresses

and tb.e Judge’s summing up. Tb.e jury returned to Court, afte'r being locked up twelve hours. Of,'the eleven issues they had to diecide, they failed to agree in the majority, including whether the respondent and co-respondent committed adultery, but found the petitioner had toramitted adultery with one Katherine Cowell in England and France. Mr Justice Waleer said the result was regrettable, but could not be helped.

Counsel tor Respondent formally moved for a decree nisi and costs

of the su’d;. The Judge noted the application, and discharged the jury.
