Michael Higgins was charged with the theft of a dog from Chas. Lennox, and also with having received the same dog knowing it to be stolen. Constable Forster prosecuted and Mr Moore defended.
Evidence for the prosecution was given by Chas. Lennox, M rs Lennox, A. West and C. F. Johnston. The accused gave evidence on his own behalf, Mr Moore contended that there was no evidence to connect accused with tbe theft even if a theft had been committed. Also that there was no evidence to show that accused had received the dog into his custody as charged, the dog having merely followed him. After consideration the Bench dismissed the charge of theft, and adjourned the hearing of the second charge to obtain the evidence of a belated witness.
