A Foxton Case.
At the Wellington S.M. Court on Friday afternoon Messrs Gillander Bros., of Foxton, sued D. L. Mclnnis for the recovery of £SO. The facts set out in the statement of claim show that in the month of April defendant offered to sell to plaintiffs the exclusive right of vending certain articles known as “ Orsa Goods,” in the territory from Foxton to the Mokau for the sum of £SO. In the course of the negotiations it was alleged defendant repeatedly represented he had the exclusive right and title to sell the goods mentioned in the area aforesaid. Plaintiffs purchased the rights—believing the representations made to them to be true —for the sum named. It is now claimed defendant had no authority or title for the district in question, and that the consideration of the purchase had failed. A return of money is accordingly sought. Mr Jellicoe appeared for plaintiffs and Mr Chapman for defendant. After two witnesses, called on behalf of plaintiffs, had been examined, the farther hearing of the case was adjourned till to-day.
