Thursday, February 3rd. (Before His Honor Judge Kettle). FALSE PRETENCES. la the case of Stubley v. Jatnieaon after counsel bad addressed the jury, Hia Honor summoned up. The jury then retired, and after an absence of 45 minutes returned with the following answers to the issue*: — 1. Did the accused, on the 9th December, 1897, give Stubl«y his (accused) cheque for £10 dated 9'h December, 1897. in exchange for £10 in carh?— Yea. 2 At the time the accused gave the cheque to Stubley, did the accused know that the cheque would not be paid if presented in the ordinary course of business? — Yes. 8 At what point of time did the accused ask Stubley to hold the j cheque over till Monday, 18ih J December, 1897?— After the transaction was completed. 4. Did the accused at the time ot giving the cheque honestly believe that 1 it would be honored on Monday, 13th December ? — No. 5. Did Stubley cash the cheque (A) believing that it was a good and valid one for the amount thereof /—Yes. 1 (B) Being induced by the statements j made to him by the accused as to his affairs ? — Yes. 6. Did the accused fraudulently intend to induce Mr Stubley to give cash for the cheque ? — Yes. Mr Marshall asked His Honor to enter up a verdict of guilty on the findings of the jury. His Honor, in addressing the prisoner, said that he was very much afraid that he (prisoner) had been travelling about the country flashing it, and it was a great pity because one possessing the ability of accused might have made a very good living if he had gone to work honestly. He would like to have admitted him to probation, but a previous conviction recorded against him prevented that. He would therefore be sentenced to twelve months' hard labour in the Wellington gaol. Mr Innes received judgment on behalf of Mr Baker.
