Magistrate's Court, Foxton.

(Before A. Greenfield, Esq., 8.M.) Saturday, 11th December. the duck case. Police v. Gbarlea Collins— The defendant was charged that on the 21st October in Union-street he did unlawfully and cruelly torture a duck the property of Mrs McCarthy. The defendant pleaded not guilty. Mary Jane McCarthy deposed that she and her son wore talking and saw the drake go into Collins. Heard Collins pay there's that drake and " catch him Freddy, catch him.'* The drake soon came up the path with his neck bleeding, the skin being cut off it. Leonard McCarthy deponed be saw the duck go through (to Collins), and watched it and heard the accused cail out "catch it Freddy" and " come and hold it Freddy," Thought they were catching it to bring it over. By Accused— Saw the drake in your hand*. You have some white duck*. You had the duck in your hands. Alfred Fraser deposed that he saw the duck in question at the Court., house. The Bkin was stripped from head to shoulders on the neok. The defendant called Clara Withers, who deposed Bhe was at service next door. Saw a duck pass bar and it was not hurt Mrs McCarthy had asked her to say it was defendant who had done the injury. Tne Magistrate did not think there was sufficient evidence to prove the damage was done by defendant and the case would be dismissed. > PROHIBITION CASKS. Police v. Thomas Barry. — He was given to excessive drinking. Order made to apply to all licensed houses in the Borough of Fox ton. Police v. Mary McGill.— No Appearance of Defendant. The police aaked for an adjournment to bext Court. Case adjourned. Police V. William Knapp. --Ac cuaed pleaded not guilty. The constable aoked to be allowed to withdraw thin case. Cane dismissed. Order raada to apply to all licensed hou3es in the Borough of Foxton. Patrick Guerin vV John McGill. The constable said there was a written admission. P. Guerin deposed that McGill had requested that an order be taken out against him. o>*der made to apply to all licensed houses in the Borough of Foxton. SCHOOL CA«E3. The following parents were fined for not sending thair children to school. (The fines were two shillings for each child absent each week) : - T. Chamberlain, W. Aldride*, E. A Williams G. Wright, J. Walls, G. Simpson, A. K-ng. P. Neylon, B. Andreaoon, W. Knapp. W. Sawyers, J Lee, J. Anderson, F. Dudson and J. Imrie. WINDOW CASE. H Border v. G. Coley. Defendant was charged that he did unlawfully break two panes of window glass of the value of £5 on 24th Navtmber. No appearance of defendant. The defendant was also charged with using threatening language on 24 h November. No appearance of defendant. Henry Border gave evidence that at a few minutes past 10 p m. the defendant knocked at bis door and wanted it open and on being refused admission threatened to break the window, he did . so, and on being remonstrated with said he would

smash another, and did so. H. Border said he believed defendant waß sorry ond he asked leave to withdraw the information as to iht threatening laijgriag'e: Thomas Bowe deposed that he Raw G. Coley on the night of the 21th November. Ooley knocked at the door and Border refuted to lei him in. Coley threatened to break the window. Witness was inside* Ooley admitted breaking the windows "*> and had offered to pay for them. The Court fined the accused 20i, in default seven days imprisonment, costs 10a. Traok. —Claim £5 2a 6d. Ordered thai amount be paid before 10th January, in default 10 days' imprisonment in ' Wanganui Gaol.
