Judgment for plaintiff for amount by default and costs Bs, solicitor's fee 53. Thomas Gordon v. F. 0. McCarthy. — Claim £1 Is. No appearance of defendant. Thomas Gordon deposed to hiring done certain work to the body of the son who was accidently killed at Shannon. The Magistrate thought the charges reasonable and gave judgment for amount. E. Y. Smyth v. Percy C. Baldwin.—Claim £8 9s 2d. Mr Innes. , for plaintiff. Mr Haggifcfc for defendant. The claim was on the substance of a contract for whioh no notice for production had been given. Mr Innes applied for an adjournment to allow notice for production being served on defendant. Adjourned to Palmerston for the 9th. F. J. Carter v. E. J. Bmyth.— Claim £3 6s 6d. Mr Bay for plaintiff. Defendant admitted claim. Judgment for amount and costs 15, solicitor's fee ss. Thos. Procter v. S. M. Baker.— Claim £4 18s 6d. Mr Innes for ~ plaintiff. Thomas Procter sued for horse feed 9 for Rangatira and board for groom. Defendant had refused to payBy Mr Baker— Frank Gay took the horse to the stables. Frank Gay deposed to talcing * ' horse to Proctor's and staying there,
Thought 6s 6d per day of 24 hours excessive charge for feed and loose box. By Baker : Took the horse to Proctor's without Baker's authority. By S.M. : Laf t Foxton for Rangitikei the day the horse went to Proctor's. For the defendant Baker called a r trainer named Blanche, who deposed that the charge of £8 23 6d was not a reasonable sum for keep and feed of the horse for the time. Usual charge per week was 25s at a livery stable. By Proctor : Do pay 5s a night at some places. Would " keep a horse for 80s for a week. A stallion's feed is worth one shilling each. Straw per night in Foxton is worth is 6d per box. S. M. Baker deposed — He had understood that the charge for board would be 15s per week. By Proctor: Would swear had never paid same price as charged even when horse had had four feeds a day. The Magistrate thought charge made was too high, and that Gay's version was correct. The accounts did not seem to have been very carefully kept. Allowed 5 days for horse at 5s a day, 4s for grass, and 14s for board, making a total of J6B Bs. No solicitor's fee allowed* A. Aff.
