Palmebston, Friday. (Before H. W. Brabant, Esq., S.M.) ALLEGED TRESPASS. M. McGauley v. S. M. Baker, claim £5. Mr Hankins for plain-,... tiff, Mr Fitzherbert for defendant, This was a case in which plaintiff jM sought to recover damages for an al- /^ leged trespass by defendant on his— property at Paiaka, Kereru. The defendant denied having trespassed on the land. It appeared that an unfenced road lino ran from the main road through plaintiff's property to defendant's land, and while plaintiff averred that defendant went on his land, defendant was positive as to keeping to the unfenced road line. nis Worship in giving judgment, said even supposing it was true that defendant acted as alleged, it was a very paltry matter to bring an action against him for. He did not think that plaintiff had made out even a technical trespass for which he could recover nominal damages. Judgment would be given for defendant, with costs, £8 19s 7 'd.— Standard.
