In Bankruptcy.

* The meeting of creditors in the bankrupt estate of Arthur Alexander Mitchell, farmer of Foxton, did not take place Monday afternoon owing to none of the creditors putting in an appearance. Debtor was, however, examined by Mr G. S. Scott (D.0.A.), and in answer to questions, said, the immediate canse of his seeking the protection of the Bankruptcy Court was through McMillan, Rhodes # & Co obtaining judgment against him for £64, and issuing a distress warrant. The bailiff served the warrant but did not seize. Promised not to reserve anything. The assets mentioned in the schedule were all he possessed. He came up to Palmersfcon and consulted Messrs Baker and Cooke, who advised him to file. McMillan, Rhodes and Co had refused to accept his assets. Had paid Messrs Baker and Cooke £9. Am living on 90 acres of land, which belonged to his father. Did not pay rent. Had not worked the land, as debtor had been carting and cutting flax by contract. Had always been paid for work he had performed. The contracts did not pay owing to debtor having taken them in the winter. Had lost time through wet weather, and stopping work to repair the tramway. Debtor did not own horses and drays, but used to hire them for his contracts. About 18 months ago witness owned 15 w 16 head of cattle, 8 horses, dray and harness. Had grazed stock for other people. Was in a solvent position at this time. Debtor's father's name was William Mitchell, and he resided in Abel Smith-street, Wellington. Am a married man with three children under 6 years of age. If allowed a month or six weeks could pay his creditor's 10s in the £ on the approved claim in the bankruptcy. The following is the statement of assets and liabilities : —

Liabilities : — Foxton : McMillan, Rhodes & Co., £64 Is 8d ; J. Walls, £8 8s ; T. Proctor, ££ 15s ; T. Newth, £8 ss ; Shannon : J. Powell, £15 ; Christchurch : J. B. Craig, £3 8s ; total, £91 18s Bd.

Assets : — Stock-in trade at Foxton consisting of one cart and harness (£22 10s), 8 cows, (£ls), 8 calves, (£2), 1 pig, (£2), dairy utensils, (£1) ; furniture, £10. Total, £51 ss, Deficiency, £40 18s Bd.
