The Case Against Daniel Jobberns.
The charge of false pretences brought against Daniel Jobberns was sonimeuced before Mr Robinson R.M. at Wellington on Friday afternoon. Mr Gully conducted the prosecution, and Mr Skerrett ap peared for the accused. The only witness examined was Thomas Roskrnge, who said he was a commercial traveller, employed by Messrs Arthur and Co., of Glasgow. In the month of April, 1889, witness entered into certain business operations with the accused, who was in Ini*iue3s at Pa'.merston North Asked accused what his financial position was. Accused said there wa3 a salary due to him, £600 and £100 on account of an insurance transac'ion, property at Masterton worth £500, also property at New town worth £1500, which was subject to a mortgage of £850. Accused estimated his profit on the Palmerston property at £600. Being crossexamined by Mr Skerrett, witness said he was not paid by commission. He received a regular salary, and the amount of orders he got did not affect his salary. It was part of his duty to ascertain the solvency and character of the person from whom lie solicited orders. Where the account was likely to be a large one he did not confine his enquiries to the one person but made a general enquiry. A report was then made out, upon which his (witness') principals could act as they thought fit. Did not take an order from the accused the day on which the interview was made, but did so a few days later. The only particulars which Messrs Arthur and Co., acted upon were the statements written out by witne's on the basis of the enquiry made from Jobberns explanation. By the Bench ; The goods ordered by Jobberns would come consigned to him from Glasgow The further honring of the case was adjourned till next Friday morning. 19. Z. Times.
