RESIDENT MAGrSTRATb/S COURT, FOXTON. :
Wednesday, November 3, 1880. (Before K. Ward, Esq., R.M.) ASSAULT. Ik John Davies was charged upon the^ information of J. Futter, proprietor of the Manawatu Hotel, with assault. Mr Futter gave evidence to the effect that Davies was at his hotel during the greater part of the previous day. It appeared Davies had had a row with a half-caste in the morning, and meeting the same per- ' son in the afternoon at the hotel the quarrel was resumed. Mr Futter insisted on the quarrel being stopped, whereupon Davies challenged him to fight, and came round to attack him in the passage. Thereupon Mr Futter put him out. James Myers gave corroborative evidence, and Win. Collins, a Maori, ' aiso supported the charge. There was a cross-action for assault, brought by Davies against Mr Futter, but the only evidence in support of the charge was his own statement. ..;" His "Worship said he would fine each defendant ss, as he considered Futter had no right in ejecting Eavies to strike him, as he admitted he had done. CIVIL CASES. Brown's Estate v. C. Brown. — Claim 11s lid. No appearance of defendant. Judgment ex parte for amount and costs, 7s. This concluded the business, and the Court adjourned.
