RESIDENT MAGISTRATE'S COURT, FOXTON.
» Wednesday, Maech 17, 1880. (Before R. Ward, Esq., R.M., and E. S. Thynne, Euq.,J.P.) , , CIVIL CASES. Loadon v. Heta.— Claim £2 18s. This case was adjourned from, last Courf day, to enable Mr Loudon to prove delivery of certaia goods, receipt of which was disputed by defendant. Mr Honore gave evidence in support of the claim. Judgment [ for amount and coats. 13s. A. 8. Kaston v. Freoland.— - Claim £5 13s Bd. No appearance of either party. Jethro Jenkins v. Perreau.— Claim £25 18s 9d, being amount due for wages owing by Simpson & Co., sawmillers. Defendant pointed out that he was sued as "a settler." His Worship pointed out that a footnote to the bill of particulars said Mr Perreau was sued as one of several parties liable. — In reply to his Worship, Mr Perreau said he was £aken by surprise by the way the action was brought, and should require production of books kept at the mill.— Plaintiff deposed to having been em* ployed by Simpson & Co., aud said he sued Mr Perreau as one of the partners ; had worked 51 days 7 hours ; sued Mr Perreau because he thought he was the best mark. His Worship gave a nonsuit, on the ground that ohe names of all the defendants were not joined in the action; nonsuited with costs, £2 15s. J. A. Torr v. J. Smith. — Claim £5 10s, balance of purchase money of 7 calves. Judgment ex parte for amount and costs, Bs. Palmer v. Perreau. — Claim £3 19s 6d, for rates due to the Foxton Local Board. Defendant said he was at preseat unable to pay, also that he had parted with the property several months before the rate was ctruck, and the purchasers promised to appeal against his (defendant's) name being allowed to remain. — His Wor. ship said he must give judgment for plaintiff. Defendant would have consulted his oVn interest by appealing himself. Judgment for plaintiff with costs, ss. Same y. Henry Fry.— "Claim £3, being rates overdue. No appearance of defendant. Judgment ex parte for amount aud costs, ss. 0. Howe v. W. Alzrtorf.— Claim £8 3s 6d (upon judgment summons) Ordered to be paid with costs, lls, within one week, in default; 14 days' imprisonment in Wanganui Gaol.
