MAINTENANCE CLAIM.

WELLINGTON, June 25. The appeal by Lady Hunter against an order made by Mr Justice MacGregor under the Family Protection Act on December 7 regarding the maintehance of her daughter Elizabeth was called at the Appeal Court this morning, but counsel for the trustees announced that a settlement had been reached, though with some hesitation on the part of the trustees, as the creditors in the estate had : not yet paid and the annuities under the will were in a parlous state, since the estate was producing no income. Under Mr Justice MacGregor's order the trustees were: authorised to apply from capital maintenance of £3 per week while the child was living with her mother, and £6 if the child were sent to a boarding school. The Court approved of the agreement made and an order was .made varying the previous one, and. providing that £200 be paid the mother for past maintenance of the daughter from the death of Sir George Hunter to December 7, and £4 10s weekly from that date. If the daughter is sent to ,a boarding school an additional £1 10s will be paid, the payments to be made to Lady Hunter, instead of to the solicitor, as formerly, and to be subject to the agreement of the creditors in the estate. If all do not agree, the payments will commence as soon as the creditors are paid.
