Resident Magistrate's Court.

HAVELOCK, JANUARY 3, 1868. [Before G, L. Hellish, Esq., R.M., and A. J. Sicklee, Esq., J.P.] Thomas Pierce, alias Roll-ancl-Co, was charged with using language and behaviour with intent to provoke a breach of the peace at Havelock, on December 20. The charge was proven by Sergt. Goodall and John O'Donnell, and even more fully established by two witnesses whom the defendant, rather unwisely, called for his defence. From a paper produced in Court, it appeared the defendant had been in custody for upwards of a dozen times on similar charges. Fined £2 and costs, or in default 48 hours imprisonment. Defendant chose the latter. James Mauley pleaded guilty to riding through a public street at Havelock in a furious manner, but also pleaded that the offence was unavoidable, as he could not hold the horse, which was very spirited. This, from a statement made by Sergeant Goodall, appeared to be the case, although it was aggravated by the.fact of defendant inadvertently using a spur. Defendant was suitably admonished as to his again holding on the horse by his spurs, and discharged on payment of costs, 7s. 6d. William Warner was charged with stealing two boat sails of the value of £3 10s. the properly of Thomas Pierce, After a careful investigation, the prisoner was discharged. From the evidence it seemed prosecutor had given prisoner a boat in lieu of wages due to him. Prosecutor denied ever giving the sails, as well as the boat, whilst it was very evident the prisoner believed he was entitled to the sails as well, hence the mistake. CIVIL CASES. HENRY BOYD V. THOMAS PIERCE. Plaintiff claimed the sum of £8 16s. 2d. on a dishonored order. Judgment for amount and costs. JOPN MULVAY V. C. DIAMENTE. v Adjourned from last Court The claim which was for £l6, for maintenance of defendant’s daughter, was nonsuited, plaintiff to pay £2 13s. costs. It appeared from the evidence of two witnesses that plaintiff’s wife took the child as a companion, without any agreement for payment. —— JANUARY 6, 1868. : [Before A. J. Sicklee, Esq., J.P.] John Mulvey, arrested on warrant for threatening his wife, ordered to find two sureties to keep the peace for three, months.
