Defendant admitted liability but pleaded inability to pay. Judgment for amount, with costs I 5&. Trenwitb. v Macdonald— Claim L 6 Is sd. Ml- Aid i-kloe for plaintiff, and Mr Henderson for, defendant. The claim was for bnbncp of account between the parties.; Defendant is the proprietor of Keaby Station, and plaintiff had been working for him in various capacities, and an account arose between them of about LlB. OE this amount Ll2 was admitted, and a set off of L 6 put in. There was no evidence but that of the parties themselves, and what they had to say was of no public interest. The case lasted a very long time. Eventually judgment ■was given equivalent to judgment for defendant, with costs, his admission and set off being a few shillings above the claim. Costs, Ll 4s. Hicks v. Potter— Claim, L 65 2s 7d. Mr Aldridge for plaintiff and Mr Henderson for defendant. There was no personal appearance of either party, It \tfas stated that there was a probability of an agreement being arrived at. The caso was adjourned till next sitting at Mataura. — Mr Henderson asked for costs, as plaintiff had agreed, at a meeting of creditors, to a composition of 6s 8d in the £; but had subsequently refused to . .sign the deed. — Mr Aldridge .objected to costs being allowed, as the . case had been previously adjourned for the convenience of defendant. — His i Worship said costs would be costs in the ;cause. ... !: . \ .
