LICENSING COURT. [Before John Allen, Esq., \V. E. Dive, Arthur Hyde, and John H. Smith, Esqs. Commissioners.] There were no applications for new licenses. All the old ones were granted and there were no complaints of any kind made against any of tlie houses. The following were granted : l’elorus Hotel, Canvastown, to John Wilson. In this case the license fee was raised from LIS to L2O. Commercial Hotel, Havelock, to Moses Fear. Couper’s Accommodation House, Pelorus Valley, to .John Cooper. Halfway House, Kaituna Valley, to John Dickson. Accommodation House, North Bank of Wairau, to Thomas Maxtcd. Masonic Hotel, Havelock, to Mary Hutchinson. Post-office Hotel, Havelock, to William Dorreen. WARDEN’S COURT. (Before J. Allen, Esq., Warden.)

Ilopgood v. Arthur. —Flooding claim. Defendant to pay costs, 21s, and to put the guago boxes in proper repair in ten (lays. The following applications for tail-races were granted :—Oorkhill and party, Leahy and Michael, and Hopgood and W ayliii. Protection was granted to J. Livingstone. . ,

Synnerholm v. Pope and Smith.— Wrongful occupation of ground. Mr McNab appeared for plaintiff. John William Synnerholm stated : 1 am a miner at Wakamarina. I proceeded to peg out some ground a week since, adjoining Antonio Maroiii’s, between 4 and 5 p. in ; it was nearly dark. I took from Mavoni’s pigs ; another party had pegged before. I re-pegged it, and stepped oft to put them in : I did not trench the ground, having no tools, intending to go back next morning, but it was then wet, as also on Saturday. On Sunday I went to put in trenches, and found defendants on the ground ; they had partly put in the pegs : they had taken one man’s ground, since which I have brought this case. I have put in trenches oft long and Gin deep ; the pegs have been thrown out. Cross-examined by Pope : I was wot Ring in a shed under cover on Friday. Cross-examined by Smith : The pegs were not thoroughly in the ground when I came down. I did not see you put any pegs in. . John Ahern stated ; I am a miner, and know Synnerholm. Flanagan has been working for the Sluicing Company. I don’t Know whether he put in the pegs by inat,inotion. Pope is living with me ; lie

did not place these pegs by instruction. Flanagan pulled up a peg and put it down again ; I have seen the pegs next to Maroni’s but was with the defendant only part of the time lie was pegging out. I did not notice the trenches ; I did not do any work outside on Friday or Saturday. James Pope, miner, at Wakamarina, stated : I was walking around looking for ground on Monday ; asked Antonio what ground there was; marked out 100 feet; put in pegs 2ft above the ground ; trenched at tiie same time I put in tlie pegs. Where there was a stump or any impediment left a mark. Plaintiff, when the ground was pegged off told me to clear out. I told him at the time it was not trenched.

Cross-examined : I went about 2 o’clock to mark off 100 ft by 100 ft and measured it prett y fair. Antonio held the tape, which was borrowed from Ahern. Arrived in Havelock on Friday. I had a miner’s right before Maroni told me of tlie ground. Mr Ahern pointed out to me tlie rules and regulations; the ground was pegged off before I saw them; hope to work the ground myself. By consent of Warden, plaintiff, and defendants, Mr Alfred Mills was deputed to examine tlie ground in question. The case was adjourned pending Mr Mills’ report. At the Court sitting in the evening, Mr Mills having viewed the ground, the Court gave the following judgment:—The defendants to surrender tlie occupation of the ground, as the plaintiff had done all he could to get his ground completed ; each party to pay his own costs. Mr Mills was awarded L 3 3s.
