RESIDENT MAGISTRATE’S COURT. Blenheim, Saturday, Oct. 30. (Before H. Melntire, Esq., R.MJ. ASSAULT. James Grainger, better known as “Jimmy the Ranger”; was charged with assaulting Owen Martin at Blenheim, on the previous evening. Complainant deposed that lie is a laborer residing in Blenheim and knows the defendant, who assaulted him in front of Penney’s Hotel the previous evening by pulling him off his horse and giving him a kick on the ribs. Some people came up and pulled defendant away. Defendant called him a number of bad names. He had given no provocation. By the defendant: —Your wife’s name did not crop up. M. Hennessey, hair-dresser, &c.. stated that lie was present and heard Martin say to Grainger, “ I see you’ve had the b sack,” and also accused him of robbery. Witness did not see the kick but saw Martin pulled off the horse. Witness interfered to prevent further violence on the part of Grainger. Cross-examined : Nothing was said about defendant’s wife, Complainant has not the use of his right hand. James Crossley gave similar testimony as to the assault. The defendant said there was an old grudge between him and Martin. Defendant had asked the latter why lie had left his place, and received a reply to “ mind his own business,” and to keep his wife, which expressions irritated him. There was an altercation, and Hennessey and Martin fell upon him. He was afraid of the police or he should have given it to Hennessey for interfering. The Court bound the defendant over in his own recognizance of LIOO to keep the peace for twelve months, and to pay costs of Court 9s and 30s for three witnesses at 10s each, and to pay a fine of LI or in default go to gaol for a month.
