RESIDENT MAGISTRATE’S COURT, BLENHEIM.
Thursday, March 25th (Before H. Mclntire, Esq., R.M.] ASSAULT. Frank Moore, of Blenheim, bootmaker, was charged with assaulting Thomas Knowles, laborer, on the 21st inst. Mr McKTab appeared for complainant and Mr Sinclair for defendant who pleaded not guilty. The case was a very trumpery one. From the evidence of Mr Gibbs and another witness it appeared the parties were at the Marlborough Hotel on the day in question. Knowles said to some young ladies Moore had “black ” hands. On the Sunday when the flood was up, defendant, who was in a boat, got out and came up to complainant, and rubbed his hands all over his face making his nose bleed. Mr Sinclair submitted that thecase ought to be dismissed, but his Worship intimating that it appeared to him an assault had been committed in a public place on a Sunday, he could hardly dismiss it. Mr Sinclair said he should call evidence for the defence, but afterwards said he would leave the matter in the hands of the Court, pointing out in mitigation that defendant had received provocation, and that a fine of Is would, in case of conviction, amply meet the justice of the case.
The R.M. fined defendant 5s and costs £2 12s.
