Conflicting Evidence. The claim of Dan Pervan (Mr W. C. Hewitt) against Charles Penetito (Mr J. D. Davies) for £147 17s 6d was upheld by Mr R. W. Dyer, S.M., at Matamata on Saturday. Plaintiff had carried out a drainage contract for defendant, but while the former was away on his honeymoon Penetito had stopped the men from working, stating that he had not enough money to pay for completion. When plaintiff returned he completed the work according to the contract. A few days before completion Penetito asked plaintiff to sign an agreement to take flax at 17s Gd per ton in payment for the drainage work- Plaintiff alleged that ho turned the agreement down. * Defendant said plaintiff verbally agreed to his proposals. Evidence was given on the latter point, and the Magistrate expressed himself as not being satisfied that plaintiff had fallen in with defendant’s proposals. His judgment was for the amount claimed less the amount of £36 4s 2d paid into court with costs.
