Lyttelton, Jan. 12th. J. F. SWINBOURNE'S ASSIGNMENT. NOTICE is Hereby Given, that in and by a certain deed, bearing date the sev enth day of February instant, John Foster Swisbotjrne, of Christchurch, in the Province of Canterbury, New Zealand, storekeeper, did bargain, sell, assign, transfer, and set over all his interest of and in the Leasehold Laud and Premises of him the said John Foster Swinbourne, fronting upon the Market-place in Clmstchuvch aforesaid, with the Messuage or Dwelling-house and Store thereon, now or late in his occupation as owner thereof. Also, all his Stock-in-Trade, Household Goods and Furniture, books of account, debt, sum and sums of money, and all other the personal estate and effects whatsoever and wheresoever of him the said John Foster Swinbourne, unto Henry John Le Crenand Edward Allen Hargreaves,oi Lyttelton, merchants, upon trust for the equal benefit of such of the Creditors of the said John Foster Swinbourne, who should execute the said Deed i within two calendar months from the date thereof, and the said Deed was executed by the said John Foster Swinbourne, Henry John Le Cren, and Edward Allen Hargreaves, on the day of the date thereof, in the presence of and attested by Richard Wormald, of Lyttelton aforesaid, solicitor, and Jonathan Redmayne, of the same place, his clerk. And Notice is hereby further Given, that the said Deed of Assignment now lies at my office, as solicitor of the said trustees, for the inspection and execution by the several creditors of the said John Foster Swinbourne, aud such of them as shall neglect or refuse to execute the said Deed within the time aforesaid will be excluded all benefit that may arise therefrom. Dated this eighth day of February, 1855. By order of the trustees, Richaed Wormald, Solicitor, London Street, Lyttelton. Notice to Mr, J. F. Swinboume's Debtors ALL Perscns who stand indebted to the Estate and Effects of John Foster Swinbourne, of Christchurch, are hereby requested forthwith to pay the amount of their several and respective debts to the said Henry John Le Cren and Edward Alien Hargreaves, the trustees acting under the said above recited Deed of Assignment, or to Richard Wormald, of Lyttelton, their Solicitor.. And Notice is also hereby Given, that in case of non-payment thereof, legal proceedings will be taken to enforce payment of the same against all defaulters without further notice. TJTIS HONOR THE SUPERINTEN-J-L DENT directs it to be notified that all persons who shall henceforth encroach on the land reserved for public roads within the Province, either by digging ditches, or raising banks thereon, will be prosecuted, and that those persons who have already so encroached will be liable at any time to be called on to replace the soil so removed or to remove the banks so made.
