A SPECIFIC GUARANTEE.
MAGISTRATE’S ADVICE TO STOCK BUYERS. (By Telegraph—Press Association.) STRATFORD, This Day. Mr Tate, S.M., yesterday gave judgment in a ease in which a claim was made for alleged loss arising from the purchase of a cow which was guaranteed sound and which turned out, on calving to be unsound. The Magistrate non-suited the plaintiff. The auc-, tioneer gave a warranty in the form of a letter to G. S. Mening that the cow was guaranteed sound. For the plaintiff it was held that this meant that the cow, was guaranteed sound at calving; but the Magistrate said it meant only that she was guaranteed at the time of the sale. He said that if farmers desired a warranty of soundness at calving, they must demand a guarantee in specific terms to that effect.
