James Stewa.it v. John Campbell.— Charged with assault. The case arose over the bad odonr emanating from the_ offal r.hat was thrown out from plaintiffs fish factory, which caused annoyance to defendant's household.

As the nuisance was not removed after making complaints by the latter, a quarrel ensued, defendant striking plaintiff. After hearing evidence on both sides defendant was fined £5 and costs £3 ss.
