want of reasonable care on the part of defendant the damages already set forth were incurrred. The contention of defendant was that he exercised reasonable care in making use of plaintiff's buggy and horses; that they were warranted to be in good order and condition, and fit for the purpose for which they had been hired; that after starting on his journey he found that the buggy and horses were quite unfit to perform what he had hired them for; and that in consequence of the unfitness the buggy broke down, came asunder, and caused the horses to bolt. It was also contended that the buggy could be repaired for £l2; that the cost of an entirely new one would be very much under the sum claiued ; that the damage to horses and harness was merely nominal, and generally that the other claims put in could not be sustained. Fourteen witnesses were examined on one side and seven on the other, amongst them being an experienced carriage builder. Mr Jones appeared for plaintiff and Mr Purkiss for defendant. The jury, after considering the evidence which had been carefully reviewed by his Honor, Judge Broad, returned a verdict for defendant, with costs of court, £3 8s; counsel's fee, £6 13s; witnesses' expenses, £l3 7s; making a total of £23 Bs.
