Friday, April 18. [Before J. Giles, Esq., R.M.]

Regina v. Andrew Fahey.—Sergeant Russell, instructed by Inspector Emerson summoned the defendant, to show cause why he should not contribute towards the support of his four children, inmates of St, Mary’s Industrial School, Nelson. From the evidence it appeared that defendant was in very poor circumstances. He had a fifth child at Larrikins, for whose maintenance he was paying 10s a week. Although he held a share in a claim, the share was not paid for, and there had only been one small washing-up. He thought he would be able to pay something at next washing.—His Worship considered it rather a hard case, and dismissed the summons without any order.

Thomas Harrold v. Denis Keogh.— This was an action for assault.—Harrolcl, on being sworn, said defendant knocked him down. He did not know whether defendant said anything; he he struck him in the face, and gouged him in the mouth. Defendant was not drunk; he might have had a glass, but he was not drunk. He himself was not drunk.—Defendant said he was the worse for liquor, and he did not know what he may have done.—His Worship said he must take the evidence as he found it. The assault appeared entirely unprovoked. Defendant would be fined 40s and 7s costs ; or, in default of payment, a week’s imprisonment.— The fine was paid.
