THE SLUDGE-CHANNEL.

The following were the proposals submitted to the Hon. the Minister of Mines by Messrs Seddon and Fitz* Gerald on behalf of the miners using the Government sludge-channel at Kuraara : 1. The sura to be paid for the privi* lege of using the sludge-channel shall be at the rate of ten shillings per week for each miner, whether owner or wages working in each claim from which water atid tailings are run into the sludge-channel, 2; The time during which such channel is Used shall be computed in each case by the time during which water is turned on and paid for. 3. The owners of any sluicing claim using the sliulge-cliUnnel shall have the free use ot the sludge-channel for a period of two mouths whilst first opening out • and the first payment for Use of the sludge-channel shall not id any case be demanded until after the lapse of a period of font? months from the date on which the said channel is first used in any claim. If good arid sufficient grounds can be shown, it shall be in the discretion of the manager to extend the time for payment in any Case, 4. Before any person shall cat into or connect with the sludge-channel, he shall apply to the Warden in the manner provided by the “ Mines Act, 1877,” and regulation made thereunder* for the granting of tail-races, and shall also state in such application the proposed fall to be given to the tail-race. 5. The owner or occupier of any tailrace discharging water and tailings into the sludge-channel shall ,at any time cease to so discharge water and tailings when required so to do by the mana"er* either verbally or in writing, and the manager shall at all times have full access to any such tail-race dr any claim connected therewith. 6. The amount, of any damages done, by the owners or occupiers of any tail-* race emptying into the sludge-channel by the construction of the tail-race or in the use of their privilege may be assessed under the provisions of the “ Mines Act, 1877,” or regulations made thereunder, or by arbitration if the parties are agreeable thereto. 7. Each person purchasing a share in any claim which is using the sludge* channel shall subscribe to these terms and conditions in a legal and binding manner before being entitled to have the use of the said channel, 8. No person shall run water or tailings into the sludge-channel, or be employed in any claim from which water or tailings are rnn, ■without the written permit of the manager stating the name of the person so authorised to use it. Any person nsing the channel without having first agreed to these terms and obtained the permit of the manager shall pay £1 per day as liqnidated damages for every day such channel is used without the manager’s permit. 9. If. the capacity of the sludgechannel shall at any time prove insufficient to carry off the tailings of all the tail-races discharging into it, priority of right to the use of the said channel shall be determined by the date of the applications for registrations of- such tail-races.
