WARDEN’S COURT.

Wednesday, March 29. [Before H. A. Stratford, Esq., Warden.] Kumara Applications. The application of Henry Fitzsiraons for an agricultural lease was refused, the Warden having no jurisdiction. J. Burrell applied by bis agent, Mr Hannan, for a residence area, fronting Main street.—Granted, the former certificate to be cancelled. On the appliettion of Mr Hannan, the following applications for residence areas, were .adjourned, and referred to the Borough Council;—Lucy Lucca, B. Bremond, H. Konnann, Jas. Phelan, F. Brubn, J. Davies, and Jos. Pfaff. * Similar applications were received from Wm. Newton, and E. Stevenson, and referred to the Borough Council. John Hampton applied for a double area. Granted subject to existing rights and certain conditions. The application of White and party for a double area was withdrawn. Montgomery and party applied by their agent, Mr Hannan, for a double area.—Granted. The following applications for tailraces were adjourned, pending the settlement of the sludge-channel diffi-

Rowe and party applied by thelt agent, Mr Hannan, for a special site.—Granted, subject to the usual Conditions-. The applicatioft of Grigg And party for a double area was granted. J. Hay applied by his agent, Mr Hannan, for a double area.—Granted. The application of Cell ins and party for the substitution of ope name for another bn a certificate was granted. The application of Tv R. Ward, by his agent, Mr Hannati, for a residence area, was objected to by J. Pascoe, and was adjourned to the next sitting of the Court. E-. Johnson and party applied for A double area.—Grabbed. The application of Isaac Chapman and Joseph Meade for a doilble area waS granted. J. Rowe and party’s application, by their agent, Mt Hannan) for a tail-racb in connection with sludge-channel, was adjourned. A special site applied for by the same parties was granted. The application of D. Mitldoon, by his agent, Mr Hannan, for a residence area, was granted; and a similar appli : cation of R. Turnbull was adjourned. The application of F. Blake for a special site was granted. M'Leod and party .applied for a double area. The application was granted. The application of Rdss and party for a special site was granted; The application of Rdtbftell and party, by their agent* Mr BarfF, for a tunnel, was objected to by Beatty and party, by their agent, Mr Hannan; This application was mixed up with ail application for an injunction, which was called upon, but was not dealt with in any manner. Eventually the application for the tunnel was granted, on the payment of £l4 eosts* to the objectors. This was in accordance with a foimer dedison of the Court. SUITS. Burgess V. Hannan appeared for the plaintiff. There was no appearance on the part of the defendant, and as the service of the Summons Was not proved, the case- Was adjourned t> the 19th April, to have service pioved at Wanganui. Lee and others v, Bourke and others.—Mr Hannan appeared for thd plaintiffs, who claimed that a tunnel registered in the names of the defend* ants, was abandoned, and that thd certificate be cancelled, and further that the names of plaintiffs be placed on the registration. The abandon!ent was admitted, and judgment by default against William Moorhead, Thomas Kearney, Peter Connellan, and John Feeny j and by consent against Patrick Bourke, Alexander Campbell, and James Tait, Tunnel decreed abandoned, and certificate numbered 18491 cancelled; Patrick Boufke to have possession of all plant in the tunnel, and three days to remove it. Each party to pay its own costs. Greenstone Applications. The application of Sheppert and party, by their agent, Mr Hannan, for a double area, was granted; Hughes and party applied tor a double area. The application was granted. The application of Dwyer and party for a dam, was granted, as Well as for a branch race. Russ and party, and J. Burr applied for amalgamation of water-raCes, The application was granted. The application ot J. Mahoney, by his agent, Mr Hannan, for protection for hia hut, was granted; G. 0 Brien also applied by his agent, Mr Hannan, for protection for but.— The application was granted; SUIT. Bruggeman and others v. D. Rainbow. Mr Hannan appeared for the plaintiffs, and Mr Barff for the defendant In thi ß case, plaintiffs claimed that defendant illegally occupied a hub and garden on their claim at Hayes Terrace. Evidence was taken, and it was shown that the but and garden bad been occupied before the. claim at the plaintiffs had been taken up. The Warden ruled that the defendant is entitled to all that area measuring 24ft, frontage to a centre in the front'of his bouse, at a sufficient distance to have the house standing on sound grounding, and wuh 48ft. depth from the front corners, each to be I2fb. from the front centre of his house. The defendant to nave three days to remove fencing and plants off any portion of the double area not included in the 24ft by 48ft. afore-mentioned. Each party to pay its own coats. The Court was then adjourned*
