ATTENTION having been directed to the fact that there are a number of persons (especially Chinese) Mining for Gold within the County of Grey and Kumara Mining District who are not the holders of “ Miners’ Rights,” or who are holding “ Miners* Rights” which have expired, the following extracts from “The Mines Act* 1877,” are published for general information. Warden’s Office, Greymouth, 31st July, 1880. THE MINES ACT. PENALTIES. 172. Any person not being the holder of a miners’ right, license or lease, duly empowering him in that behalf, who shall mine for gold or occupy or carry any business upon any Crown lands shall be liable to the penalties following—that is to say j—For the first offence, a suui not exceeding five pounds; for the second or any subsequent offence, a sum not exceeding ten pounds nor less than five pounds, with imprisonment in Some gaol, there to remain for any time not exceeding one calendar,month for every five pounds of fractional part of five pounds So to be paid; Provided always that in any case where a miners’right or business license may have been lost of destroyed and tile existence of such right or license can be proved, it shall be lawful to issue tb such person a duplicate of such miners’ fight or license in lieu of and comprising the like rights and privileges of such lost of destroyed right of license, until the due expiration of the same* and for Which the fee of one shilling shall be paid in case miners’, right and five shillings in the case a business , license, and a statutory declaration shall in all such cases.be made as to . identity aiid the facts of the case. 173. Any person who shall knowingly miheor employ any person to mihe for gold on any land belonging to a private individual, without the consent of the Owner thereof or his duly authorised agent, shall be subject to the like penalties as are mentioned in the last pfeceding clause. 174; If any pefson shall forge or alter aiiy miners’ fight, license, lease or othef document issued under the authority of this Act with irtteht tb defeat the provisions of this Act, of to defraud any persons whomsover* he shall be guilty of & misdemeanour, and on conviction thereof before any Court of competent jurisdiction shall be subject to a fine hot exceeding bne huudfed pounds, of imprisonment with or without hard labor not exceeding three years, of bbth* at the discretion of the Court. 175. If ahy pefson shall use of exhibit any forged miners’ right, license or lease, issued or purporting to be issued Under the authority of this Act, knowing the same to be forged, of if any person shall fraudulently personate the holder of ahy such miners’ fight, license br lease, shall falsely or fraudulently repfeseht that ahy servant of other person is an. authorised person within the meaning of this Act, or Shall fraudulently use of exhibit as his own ahy miners’ right, license or lease, belonging to or granted to ahy other person, or shall vise or exhibit aS valid a miners* fight, license or lease, which shall have expifed, he shall be liable to a penalty for every offence not exceeding fifty pounds, or to imprisonment with or Without hard labor; ript exceeding' one year, or both, at the discretion of the Court; tOTICE TO MINE-RS.
