Thursday, May 20. [Before J. Maokay, Esq:, R.M.] DRUNKENNESS. ' Ellen Simpsonj for this offence, was fined 10s or 24 hours' imprisonment. CIVIL CASES. R. J. Seddon v. W. Holley.—Claim, £8 17s, balance due on a dishonored promissory note. Judgment was given fori the amount claimed, and 8s costs of Court. Same v. R. Lewis.—Claim .£9 los 6dj for balance due on goods supplied the defendant. Judgment* was given by; default for the plaintiff for the amount claimed, less £3 paid since the issue of the summons. Brown v. Mulligan.—Claim £5, for value of a pet dog killed by another dog belonging to the defendant. Judgi niept was given for the plaintiff for,the amount claimed, with 6s costs of Court. Millson -v. D. Murphy.—Mr Perkins for plaintiff, and Mr Guinness for defendant. Claim £ll 17s 6d, which the plaintiff sued the defendant for, as being the amount he (the plaintiff) had paid for a dairy cow, bought on commission for the defendant at his request, including £l, the amount of the commission agreed on. Several witnesses were called for the defendant, who proved that the cow was wild and unmanageable, and perfectly useless as a niilch cow. On the other hand, it was shown that the plaintiff,, acting as agent for the defendant, : had; to the best of his judgment, bought a cow which was guaranteed as a good quiet cow. The Magistrate coincided with the view taken, by Mr Perkius, that the plaintiff was ouly. an agent in the matter, and 'gave judgment for the amount claimed, with costs of Court £1 4s, witnesses costs £2 Bs,. and professional costs £ lis. Seddon v. Davidson and Wiliiams;—Claim, £S 7s, being amount of a dishonored acceptance. White v. Creed.—Mr Perkins for' plaintiff, and Mr Guinness for the defendant. This case was adjourned till the next sitting of the Court, as a setoff of £2 ~7s was put in at the "last moment, and the Court ordered that the set-off, as also the bill of paiticulars attached td tile summons fee afflerided ; ; the costs of the adjournment to abide the result of the suit.
