Tuesday, 16th March. [Before J. Mackay* Esq., R.M.] of The jiunlcHpal bye-law ; s. Daniel Carboy was charged with allowing a waggon to remain in Main street, contrary to the bye-laws of the borough. The defendant, who pleaded guilty, was fined ss, And 5s costs of Court. dBSCENE LANGUAGE; Jane Wilson was charged with Using obscene language within the hearing of a constable, in Main Street. The defendant, who pleaded guilty, but that it Was uttered through aggravation, was fined 20s and Costs* or 14 days’ imprisonment with hard labor. CIVIL CASES. Tenent V; Quenlin : claim £1 13s, for meat supplied.—Defendant did not appear, and judgment was given for the plaintiff, with costs of Court, Mayor and Borough Councillors of Kumara v. J. B. Clarke : claim £l, for rates.—There was no appearance of defendant, and judgment was given for the plaintiffs, with costs. Cuming v. Woods { claim £33 18a fid, for services rendered by the plaintiff as clerk and assistant.—Mr Guinliess:appeared for the plaintiff, and Mr Button for the defendant. From the evidence it appeared that the plaintiff land defendant had very recently been in partnership, and, since the dissolution of this partnership the plaintiff had continued to act in the same capacity in the business as formerly, under the impression that he would be recompensed for his services. To this the defendant stated there was neither agreement nor understanding, and although admitting that the plaintiff performed certain duties in the business, contended that he did it of his own free-will, and received his board and lodging for so doing. After hearing a lai-ge amount of evidence, in which the. partnership accounts formed a leading feature, the Court gave judgment for the plaintiff for £B’l7s, with costs.
