TE KUITI MAGISTRATE'S COURT.

THURSDAY, 17th SEPTEMBER, 1914. Before Mr E. Rawaon, S.M. Stevens , Bennett, claim £ls Ha 5d for goods supplied,to defendant's driver. Mr Howarth appeared for plaintiff and Mr Sharpies for defendant. It appears that Mr Stevenß supplied goods to a man named McGarvey who was driving for defendant, on the understanding that the same were to be charged to defendant. For the defence it was contended McGarvey was not agent for defendant and wub not working, for'him when some of the poods wero obtained, therefore liability waß denied. After hearing counsel on the law points his Worship non-suited plaintiff with costs. Aldridge Bros. v. Flett, claim £35. Mr Sharpies appeared for plaintiff and Mr Howarth for defendant. Tho matter in dispute was aa to whether plaintiffs had carried out their contract tffl supply logs to defendant's sawmill. Defendant admitted he had deducted the amount claimed from the .sum which plaintiffs would have been entitled to had the contract been carried out properly,but claimed as a set-off that he had sustained a greater amount in losb through plaintiffs failing to carry out their contract properly. After hearing evidence and the arguments of counsel, his Worship gave judgment for plaintiffs for £23 17s 6d and costs, and allowed coßts to defendant on the counter claim. Hattaway v. Jordan, claim £ls Is 2d and counter claim of Jordan v. Hattaway £lO 12s 9d. Mr Howarth appeared for Mr Hattaway and Mr Sharpies for Mr Jordan. After hearing evidence, judgment was given for plaintiff on tho claim, less £5 3s 5d paid into Court, and for plaintiff in the counter claim for £lO 12s 9d and cost £2s 2s. Fencing Claim.—ln tho caso in which H.. J. T. Jaffard, represented by Mr Howarth, claimed £34 lis lOd from Raupi and several other Maoris, judgment was entered up for plaintiff for £33 Is lid and costs £l7 17s.
