A FENCING CONTRACT.
THE CLAIM DISPUTED. At a special sitting of the Court, held at Te Kuiti last week, before Mr F. O'B. Loughnan, S.M., J. McDiarmid, represented by Mr Sharpies, claimed from Robert Were, for whom Mr Finlay appeared, the sum of £SB 8s 6d, for a fencing contract. The facts as stated by the plaintiff were that he entered into a contract to erect fences for defendant at the rate of 15s per chain with certain extras such as felling trees overhanging the line and jacking fallen trees off the line. The facts were admitted by the defendant except that he denied making an, allowance for jacking. Plaintiff also claimed as an extra a gateway which defendant"'contended was part of the contract. A portion of the claim which was for posts and battens destroyed by fire was disputed by defendant, who denied having started the fire which burnt the material. After hearing lengthy evidence, his worship gave judgment for plaintiff for £35 17s 3d and costs £l2 17s 9d. A portion of the claim, which was for shifting logs from the road was disallowed against defendant it being understood the matter could be arranged with the Roads Department.
