In the Singer case the assistant manager gave evidence that he and the cashier knew of Brown's overdraft;. The amount and period it covered war. disclosed by the books. Brown had absolute power and MacPherson had So lake instructiona from Brown. Witness knew nothing of how Brown's overdraft was wiped o(T till he received confession, which led to the present pro-; ceedings. There wa;- nothing to show I that Mac.Plierron acted wrongly or in concert with anyone else. Witness wired Brown who was then in India, stating (hat MaePhcrson had made a confession. and absconded, and asking for instructions. Brown replied to use his own judgment and be guided by circumstances. Amongst the evidence was a letter from Brown to witness asking witness to destroy the old cash books and letters in view of the possibility of a checker coming from Nesv York.
