REASONABLE CARE
At Te Kuiti Maigstrate's Court pn Thursday, before Mr F. O'B. Loughnan, S.M., E. B. Dufaur (Mr G. P. Finlay) was charged with sending liquor into the King Country without having notified the clerk of the court atT e Kuiti. Constable Mathmv stated that a notice had been sent to T;uim;irj'nui..
Mr Finlay entered a plea of not guilty and pointed out to Constable Mathew that a notice had been sent, to To Kuiti. Questioned as regards the record kept, the constable said that it was a pretty good one and one that it was scarcely possible to make a mistake.
Mr Finlay then handed to the magistrate a Post Office record showing that a registered letter had been sent, by E. R. Dufaur and Co.. to both Te Kuiti and Tatirnarunui. The notice received at Te Kuiti had been signed for by Constable Capp. His Worship dismissed the case. Mr Finlay made application for costs.
His Worship said that it was not usual to grant costs against, the police and reserved his decision.
Hancock and Co., who had sen), their notice to the wrong court, were fined Is and costs.
Cooke and Co. (Air Finlay') forwarded a notice three days late and were fined a siimlar amount.
