Ohura Court Case

At the last sitting of the Taumarunui Court, Mr Cutten S.M. delivered an important judgment in a dairy factory case, Brasch v. Coventry. The evidence showed that plaintiff started a dairv factory about eighteen months ago at Matiere. Ohura. Defendant signed an agreement to supply milk of 12 cows. He failed to do so, alleging he signed conditionally that the milk of TOO cows would be available from suppliers, which was not forthcoming. " The agreement produced, contained a clause specifying that plaintiff need not necessarily start a factory unless 700 cows were guaranteed; but there appeared to be nothing to free defendant from his undertaking if plaintiff started business with less than 700 cows. Mr E. Northcroft, for plaintiff, and Mr Hine, for defendant, addressed the cmrrt. His Worship reviewed the facts, and held that the agreement was in good order, and defendant must abide by it Judgment \vent against defendant, with costs.
