TE KUITI POLICE COURT.

Fkihay, Dice, i.yni, 1907.

(Before Messrs J. Tammadge and F. 11. Sims, Js.P.) ASSAULT. Thomas Wyatt was charged with assaulting Austin Curtin on December 6th, by striking him on the head with a shovel. It appeared, from the evidence of complainant, that the parties were mates on the road work at Mangakatote, near Paemako, and Curtin staled that as a result of an altercation during the course of the work, defendant struck him with a shovel and inllictcd a cut on his head. Wyatt, in giving evidence for he defence, staled that ('urtin, during the 'altercation, raised a pick, and thinking Curtin was going 1o strike, he swung the shovel up and it glanced off the pick and grazed ("urtin 011 the head. There was no further evidence and the Bench dismissed the case, each parly lo pay his own costs.
