UNFENCED CLIFFS.
CITY COUNCIL’S LIABILITY.
STEPS TAKEN IN AUCKLAND,
Whether a legal liability is incurred through failure to fence dangerous points on cliffs on waterfront parks and reserves was a; question before -
the Auckland City Council last evening.
The city engineer, Mr W. E. Bush, reported that if such were done, fencing would be required at Point Chevalier Park, Westmere Park, Point Erin Park, and Parnell Park.
The city solicitor, Mr J. Stanton, said the question of liability was ohe which, in the ordinary way, would have to be answered b” a jury, and it was impossible to lay down any principles or rules which would assist in determining the answer. It was suggqsted that the council should form it’s own conclusions, and take steps tp safeguard any place considered dangerous.
The Mayor, Mr G. Baildon, said the parks superintendent would attend to fences which had fallen into disrepair.
