ALLEGED MANSLAUGHTER
OPAPA RAILWAY ACCIDENT. ENGINE-DRIVER CHARGED. NAPIER, Nov. 19. Frederick Lavin, the driver of the express train which left the rails at Opapa on September 22, appeared in, Court to-day to face a charge of manslaughter. • „ v ' Mr R. W. Dyer, S.M., was on the /Bench. Keen interest had been aroused, and thb Court was crowded. There is a big list of witnesses to be heard, including several whose testimony will be of an expert nature. Detective Butler is> conducting the case for the Crown, Mr B. J. Dean appeared for Lavin, and Mr H. B. Lusk for the Railway Department; while Mr E. J. Hallet is acting for the rel.a-, ■tives of Miss Kathleen Begby (deceased), and Mr M. Gleeson for .the fireman (T. Donovan), and S. Marxhall (engine-driver, who was a passenger on the train). Detective Butler briefly outlined the case before proceeding with the evidence. Lavin is charged with having caused the deaths of Murdock Campbell, E. V. Iggulden, and Kathleen Begby through his failure to observe proper precautions and care in the running of his engine, thus committing the crime of manslaughter.
