A DEBTOR IN TROUBLE.

SUED FOR COST OF CAR HERE. ' ' ORDER FOR PAYMENT MADE. At the Magistrate’s Court, Paeroa, before Mr J. H. Salmon, S.M., on Monday, MOssns Brenan and Co., Ltd., - proceeded against W. Pearcey, labourer, Paeroa, on a judgment summons for the amount of £5 4s 6d alleged to be due for motor-car. hire. Mr R. S. .Carden appeared for the firm, and.Mr C. N. O’Neill for the judgment debtor. Under examination debtor admitted that the judgment had been obtained against him in May .last. His total - earnings since that date had only Amounted to £35 Is 6d. He had been t employed by Messis Quinlivan Bros, on labouring work. The money had been used to buy food and other household necessaries. He had no children, and'was not paying any rent. His wife was delicate, and he had had expenses for medicines. He stoutly denied . that he frequented Hikutaia, and stated that he had not -■ been there for over nine months. Mr Carden, in answer .to the Bench, said that debtor had been bef&rq the Court previously, and that he was an. unsatisfactory man to do business; with. The debtor, in his opinion, was rather disinclined to work steadily. The account had been incurred by hiring cars to go to Hikutaia. Mr O’Neill said that the debtor was a good worker, and was doing hip best to meet his liabilities. In addition, for some time he had maintained a relative in an institution, and that expense had kept him back. Pearcey had now obtained a position with the Public Works Department,.’ and intended -to make every endeavour to keep up with his liabilities. Mr - O’Neill, pointed out that the debtorwas not the class, of man who would’ contract debts without a reasonable: s prospect bf payment. His Worship agreed, and said that’, that point had not been suggested. An order was made for payment, in? default five days’ imprisonment, the: warrant to be suspended so long as: debtor paid £1 a month, the first payment to be madd on December 2.
