NEW ORDER REFUSED.

CASE OF PAEROA EX-SOLICITOR.

At the Magistrate’s Court, Paeroa, before Mr. J. H. Salmon, S.M., on Monday, an application by J. L. Hanna to have cancelled a judgment summons order made on September 8 last was heard

Mr .E W. Porritt appeared for Messrs Kenny and Sous, tlie judgment creditors, and opposed the application. He explained that Hanna had been ordered to pay £42 6s 9d forthwith to Messrs Kenny and Sons in September last, in default 42 days’ imprisonment. Since the order v-as made Hanna had applied for a rehearing. Nothing had been paid off the amount sued for.

The ‘Magistrate said he would view the case as an ordinary judgment summons.

In the examination by Mr Porritt Hanna said that his earnings since June last, when he sold his practice in Paeroa, had amounted to about £26 17s. His expenditure, including rent and petty expenses, totalled about £2 a week. He had assigned the whole of his assets to his creditors, and J the affairs were competently handled at least £3OO should be realised. Messrs Kenny and Sons had refused to join in the assignment. Under pressure by Mr Porritt Hanna, admitted that certain pressing claims had been settled, and stated that his friends had helped him, in some instances without his knowledge. 'At the present time he had no means of meeting tlie claim, but he was willing to pay- an soon as possible. The Magistrate said that had the debtor tendered that information at the previous hearing a great deal of trouble and expense would have’been saved. Under the circumstances the previous order would be cancelled and a new order’would not be made.
