MAGISTRATE’S COURT.

MONDAY. NOVEMBER 3, 1924. (Before Mr J. H. Salmon, S.M.) JUDGMENT SUMMONS. At the Paeroa Magistrate’s Court to-aay an application was made by the Paeroa Engineering C., Ltd., for a judgment summons against E. C. Dally for £ll 14s 6d. Mr C. N. O’Neill appeared for the company and asked that an order be granted. E. C. Dally said that he was formerly ferryman at Wharepoa, but he was. now working at Waikino. His wages were £3 17s a week, out of which he had to provide for a family of seven. The motor-car on which the repairs had been done did not belong tc him, and he had bad a loan o£ it provided it was kept .in repair.

Under pressure defendant admitted that the car was the propel ty of Mrs A. E. Morqueest. The car had not been sold.

Defendant said that he did not have a farm, and was paying rent for a house at Owharoa and was paying for his furniture by instalments. Had the ferry service been maintained defendant said .that he would have been able to meet his liabilities. To His Worship defendant said that his work varied, and there wap a lot of broken time for which he did not get paid.

His Worship said that under the circumstances he would not make an order, but defendant must meet the debt before he paid off other liabilities.
