WARDEN’S COURT.

MONDAY, JULY 7, 1924. (Before Mr J. H. Salmon, Warden.) At the Warden’s Court, Paeroa, on Monday the following applications were dealt with by Mr J. H, Salmon, Warden: — T. M. Shaw and A. W. Green, for six months’ protection on the Junction Extended river claim No. 9246. — Granted. Elizabeth Green, surrender of residence site license 7725. —Accepted. Frank L. Brown, for residence, site of two roods in Block 111, Karangahake.. —Granted. David Sheehan and party, for reduction of rent to 2s 6d per acre foxsix months on S.Q.C. 208.—Recommended to Minister. CLAIM FOR DAMAGES. At a special sitting of the Court at Paeroa on June 16 A. W. Green, F. R. Inglis, W. M. Johnstone, and.F. M. Shore (Mr Porritt) claimed the sum of £lOOO and injunctioxi against R. M. Aitker. and Sons (Mr E. J. Clendon). The statement of claim set out that the plaintiffs were the holders ol miner’s x-ights and that Green and Shore were the registered owners of a river claim at Kaangahake known as the Junction Extended. It was alleged that defendants during the months of August and September. 1923, trespassed on the claim and removed a quantity of tailings containing gold, amalgam, bullion, and concentrate of an estimated value of £7OO. Defendants were also alleged to have dumped a quantity of old iron on the claim, thereby hampering and obstructing the plaintiffs in carrying on operations, and also that defendant’s son, Alexander Aitken, had prevented workmen employed by plaintiffs from working the claim since January of this year. The sum of £7OO was claimed as the value of the tailings alleged to have been removed and £3OO for damages and losses caused by the alleged obstruction of defendants. After visiting the site at Karangahake the Warden heard legal argument, and technical evidence at the Court. At Monday’s sitting Mr Salmon intimated that plaintiffs would be nonsuited with costs amounting to £49 4.3 6d to defendants.
