WAIHI BEACH RESERVE.

* ■ COUNCIL’S INSTRUCTIONS FLOUTED. DAMAGE ALLEGED. LITIGATION PROBABLE. With regard tp the progress of affairs in connection with the Waihi Beach Reserve it would appear that interesting developments are likely in the near future (says the Waihi Daily Telegraph). Certain correspondence has recently passed between Mrs Shaw and the Waihi Borough concerning details of arrangement, as affecting the interests of both parties. As a result of information received a borough official visited the Waihi Beach on Thursday afternoon and is said to have found matters very different. to. what, had been represented by Mrs Shaw or her agents. It was learned that the pigs, which Mrs had promised to remove weqe still at large on the property and were doing considerable damage. It was also noted that much of the fencing on tne reserve had been removed. The shanty, which some few weeks ago was dismantled on instructions issued by Mrs Shaw, and for the rd-erection of which the Council issued a demand upon that lady, has not been reinstated. Meanwhile the material is scattered over the ground, and some of it is missing altogether. The position of another shanty claimed by Mrs Shaw was investigated from a legal standpoint and the necessary data was tabulated for ■ future possible litigation. The visiting official took possession of the shanty, and had it securely locked.

The Mayor .when seen on Friday morning said that he was extremely sorry to learn that ,the attitude adopted by the late owner of the reserve did not appear conducive to a harmonious settlement of the outstanding details which remain to be arranged between the borough and Mrs Shaw. Mr Donaldson added that bad it been at al! possible for some responsible party to be entrusted by Mrs Shaw to meet the committee of the Council tne outstanding matters could no doubt be arranged with little difficulty, including the adjustment in connection with the house owned by Mr E. Shaw, and the adjoining place owned by Miss Minnie Shaw. There was also the question of the collection of back rents, which, together with the matters referred to, the Mayor thought might have been adjusted to mutual benefit, and very much to the financial benefit of Mrs Shaw herself. Continuing, Mr Donaldson said that he would be extremely sorry to be compelled to press for every legal right to which the borough was entitled, and which in the face of the present aspect of affairs at the beacn appeared to him ,to be the only possible course that Mrs Shaw was leaving for the borough to adopt.
